Welcome to Black Label Vinyl. By accessing our website or placing an order, you agree to the following Terms & Conditions. Please read them carefully before purchasing.
1. About Black Label Vinyl
Black Label Vinyl is a Texas-based company specializing in custom, made-to-order vinyl records. Every record is individually produced based on customer-submitted audio and artwork.
Because our products are custom, certain policies apply regarding production, refunds, and usage rights.
2. Eligibility
To place an order with Black Label Vinyl, you must be 18 years of age or older. By purchasing from our website, you confirm that you meet this requirement and have the legal authority to enter into this agreement and to submit all provided content.
3. Customer-Provided Content & Rights
By submitting audio files, images, artwork, or other materials (“Content”), you confirm that:

You own the rights to the Content or have obtained proper permission or licenses to use it

Your Content does not infringe on copyrights, trademarks, or intellectual property rights of any third party

Your Content does not contain illegal, hateful, or prohibited material
Copyright Responsibility:
The customer assumes full responsibility for any copyright infringement, licensing violations, or legal claims related to submitted Content. Black Label Vinyl is not liable for customer-provided materials.
Usage Rights:
By submitting Content, you grant Black Label Vinyl permission to use images of the finished record for marketing, promotional, website, and social media purposes. Customers may opt out of promotional use by contacting us in writing.
Black Label Vinyl does not claim ownership of your original Content.
4. Prohibited Content
We do not accept Content that includes:

Copyrighted music or artwork without proper rights

Illegal, hateful, defamatory, or harmful material

Explicit or prohibited content
We reserve the right to refuse or cancel orders containing prohibited Content.
5. Audio & Playback Expectations
Black Label Vinyl records are lathe-cut, not mass-pressed.
By purchasing, you acknowledge that:

Lathe-cut vinyl may sound different than pressed vinyl

Minor surface noise or subtle variations are normal

Audio quality depends on the source files provided
These characteristics are part of the custom vinyl process and are not considered defects.
6. Order Changes & Production
Orders may be edited only before production begins.
Production typically begins shortly after all required files are received.
Once a record has entered production:

Audio, artwork, and order details cannot be changed

Orders cannot be canceled
It is the customer’s responsibility to review all files carefully before approval.
7. Refunds, Returns & Replacements
Because all records are custom-made:

No returns are accepted

No refunds are issued once production has started
Before production:
Refunds may be requested if the order has not yet entered production.
Manufacturing defects:
If your record arrives with a verified manufacturing defect, Black Label Vinyl will replace the record. If a replacement cannot resolve the issue, a refund may be issued.

8. Shipping & International Orders
Black Label Vinyl ships to the United States and Canada.
Delivery timeframes are estimates and are not guaranteed. Delays may occur due to carrier issues, weather, customs processing, or other factors outside our control.
Canadian orders may be subject to import duties, taxes, or customs fees determined by Canadian authorities. These fees are the responsibility of the recipient.
Black Label Vinyl is not responsible for customs delays or additional charges imposed by international authorities.
All orders are billed in U.S. Dollars (USD) unless otherwise stated.
9. Limitation of Liability
To the fullest extent permitted by law:

Black Label Vinyl’s liability is limited to the purchase price of the product

We are not responsible for indirect, incidental, or consequential damages
This includes loss of data, emotional distress, or third-party claims related to customer-provided Content.
10. Pricing, Availability & Promotions
We reserve the right to:

Modify pricing, products, or availability at any time

Correct pricing errors

Limit or discontinue promotions
Discount codes are non-transferable and may be modified or canceled at our discretion.
11. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of the State of Texas, United States. Any disputes arising from or related to these terms or your use of this website shall be resolved exclusively in courts located within Texas.
12. Changes to These Terms
We may update these Terms & Conditions at any time. Continued use of our website or services constitutes acceptance of the updated terms.
